Who has rights to the beaches, especially all the way up against the dune, in Florida? I may have a chance at living in a condo along the ocean in Melbourne Beach this summer for my internship and am curious what the rules would be for pulling my Hobie all the way up to the edge of the dune for storage.

We've left boats on the beach overnight without problems but I would be worried that the city may not like that for 3 months or so.

I would assume the city or state owns all of the beach/dunes but maybe they won't mind the boat being there as long as it is quiet and doesn't impede sea turtle hatching? Any ideas guys?

This issue has been ongoing in the courts for years. Some say the property owners line is the "high water line"; (what is wet). Others say if the beach erodes then your property is no longer there. Check the local Brevard county municode for verification or call the county. As for the dunes, most of them are protected year round, either because of the vegetation or sea turtle nesting season which runs from May til October. Again check with Brevard County under their codes and ordinances.

Thank you Paul and Jim. I'll give them a call sometime when I get a chance. My fingers are crossed that I get this condo for my internship. It would be awesome to be right there on the beach with my boat right there on the ocean already!

The lot to the south also looks appealing. Might be another option if the ledge isn't too high.

Hi Mark!

I was thinking the same thing about that lot next door. I'm not sure how old that satellite image is but if that lot is still open and easy to access I'll have to invite all of the cat sailors in the area over for some ocean sailing and a barbeque.

Fingers crossed that I actually get this condo!

Plot twist! I never was able to get this place back in 2012 but I did just accept a full time offer down there and also just signed for a condo in Satellite Beach. My question still remains about beach rights so I will need to do some research.
